In 2014 Northwestern’s football players tried to organize a union under the National Labor Relations Act. The NLRB declined jurisdiction. Then came the Alston decision, opening the gates on compensation to athletes. At the same time, under the Biden Administration, the GC of the NLRB issued an unfair labor practice charge against USC over whether the players were properly classified as non-employees. Then came the Dartmouth College, where the men’s basketball team voted to unionize. Although the Regional Office of the NLRB has found the members to be employees, in anticipation of a new NLRB majority withdrew the petition.
Since that time, and with the House settlement approved, the floodgates opened on NIL compensation and the union “movement” energy shifted more toward individual player contracts. With the settlement now in place and the money and opportunity flowing to players, voices are again rising that a collective bargaining agreement is needed to frame and control the NIL environment.

Michael Marino is a NYC-based management labor, employment and entertainment lawyer who for decades has represented corporations, executives, celebrities, sports figures, and influencers. A member of the College of Labor and Employment Lawyers, he has tried federal court cases across the country and negotiated hundreds of collective bargaining and marketing agreements. Before entering private practice, he served proudly as an officer in the United States Marine Corps, and as Special Counsel to the Secretary of the Navy. He is a graduate of Georgetown University Law Center, Syracuse University College of Law, and Cornell University’s School of Industrial and Labor Relations.
